1. Who we are and what these terms cover

#

The Comic Chronicler (the "Service"), available at TheComicChronicler.com, is operated by Ankit Cherian, an individual based in Connecticut ("we", "us", "our"). These Terms of Service ("Terms") are a contract between you and us. They cover the website, its free and paid features, and the emails we send about it.

You accept these Terms when you tick the box to agree to them in the Service, for example before your first question or before you subscribe. If you do not agree, do not use the Service. Our Privacy Policy and Refund and Cancellation Policy are part of these Terms.

2. Who can use the Service

#
  • You must be at least 18 years old. We ask for your birth month and year before your first question. If you are under 18, you may not use the Service, and we will not let you continue.
  • The Service is offered to people in the United States. It is not available in the European Economic Area, the United Kingdom or Switzerland, and we block sign-in, checkout and AI features for visitors from those places.
  • Paid plans are available only to United States residents with a United States billing address. If a purchase is made with a billing address outside the United States, we will cancel it and refund it.
  • If you sign in, you do so with a Google account. You are responsible for activity under your account and for keeping access to your Google account secure.

3. AI-generated answers and their limits

#

The Comic Chronicler answers questions about DC and Marvel comics, reading orders and continuity. Answers are generated by artificial intelligence (Google's Gemini models), not written by a person. Some answers also draw on Google Search results and on a reference library we maintain.

AI answers can be wrong. They may contain incorrect issue numbers, dates, character details or continuity, and they may be incomplete or out of date. Check important details against the comics themselves. Do not rely on the Service for legal, medical, financial or other professional advice. We do not guarantee that any answer is accurate, complete or current.

4. Not affiliated with DC or Marvel

#

The Comic Chronicler is an independent, unofficial fan-made tool. It is not affiliated with, endorsed by, or sponsored by DC Comics, Marvel, Warner Bros. Discovery or The Walt Disney Company. All character names, titles and related marks belong to their owners and are used only to identify the comics being discussed.

5. Your content, AI output and how we use them

#
  • "Your content" means the questions, images and other material you submit. You keep any rights you have in your content.
  • You give us permission to store, process and transmit your content only as needed to run the Service for you, including sending it to the service providers named in the Privacy Policy (for example, Google's Gemini API, which generates the answer).
  • You own your output. As between you and us, you own the answers the Service generates for you ("output") and may use them for any lawful purpose, subject to these Terms and to the rights of others. Output may quote or describe comics, characters and other works whose owners keep their rights. Other people asking similar questions can receive similar or identical output, so output is not unique to you, and we do not promise that output can be protected by copyright.
  • We do not use your content or output to train AI models. The Privacy Policy explains how Google handles what we send it.
  • Do not submit sensitive personal information such as health details, financial account numbers, government ID numbers, or information about other people. If you choose to include it, we process it only to answer your question, as described in the Privacy Policy.
  • You are responsible for having the right to submit any image you upload.

6. Acceptable use

#

You agree not to:

  • use the Service if you are under 18, or on behalf of someone under 18;
  • break the law, infringe anyone's intellectual-property or privacy rights, or harass, threaten or defame anyone;
  • try to generate sexual content involving minors, hateful or violent extremist content, malware, spam, or content that deceptively presents AI output as human-written;
  • try to get around usage limits, safety filters, region restrictions or the age requirement, including by creating multiple accounts or using automated tools;
  • scrape, copy, resell or redistribute the Service or its answers in bulk, or use them to build a competing model or dataset;
  • interfere with the Service's security or operation.

These rules include Google's Generative AI Prohibited Use Policy, which applies to anything sent to the Gemini API. We may limit, suspend or end access for anyone who breaks these rules.

7. Plans and usage limits

#

Each plan has usage limits. The table shows the limits the Service applies today. Daily limits reset each day, and monthly limits reset each calendar month. Limits may change. The current limits are always on the Pricing page, and paid subscribers get notice of changes as described in section 8.

Service pauses. We cap our total monthly AI spending. If that cap is reached, AI features pause for the rest of that calendar month: free features first, and paid features too if spending reaches a higher limit. The rest of the website stays available.

8. Key terms for paid plans

#

Before you pay, we show you a written notice of the plan's key terms and ask you to accept them with a checkbox, as Connecticut Public Act 26-15, Section 1 requires. By accepting, you agree that:

  1. Quantitative limits. Each plan has daily or monthly limits on questions, Deep Research reports, reading suggestions and image analysis, as listed in section 7 and in the notice.
  2. Qualitative limits. Paid plans use the AI models we choose. We may change models or model settings, which can change answer speed, length or quality.
  3. Cost and capacity limits. To keep the Service sustainable, we cap our total monthly AI spending. If that cap is reached, we may pause or slow free and paid AI features for the rest of that calendar month. Your subscription and billing continue during a pause. You can cancel at any time, and you may ask us for a goodwill refund, which we decide case by case (see the Refund and Cancellation Policy).
  4. Conduct-based limits. We may limit, suspend or remove access for abuse, automated use, attempts to get around limits, or breaking these Terms.
  5. Changes at renewal. If we add or tighten a limit for your plan, we will tell you before the change applies to your subscription, and we will ask you to accept the new key terms before we renew your subscription where the law requires it.

9. Who sells paid plans

#

New subscriptions are sold through Stripe Managed Payments. For those purchases, Stripe, or the Stripe affiliate named at checkout, is the merchant of record and reseller. It sells the subscription to you, charges your payment method, calculates and collects any sales tax, sends receipts, and handles refunds and payment disputes. Stripe's terms shown at checkout also apply to that purchase. We provide the Service you subscribe to.

If your subscription started before we moved to Stripe Managed Payments, we are the seller and Stripe processes your payments for us. These Terms apply to both kinds of subscription.

10. Subscriptions and automatic renewal

#
  • Paid plans renew automatically every month until you cancel. Each month you are charged the plan price shown at checkout, plus any applicable sales tax, using the payment method on file.
  • How to cancel. Cancel online at any time: sign in, open Settings or the Pricing page, choose Manage Billing, and cancel on the Stripe billing page that opens. Subscriptions sold through Stripe Managed Payments can also be cancelled from the link in Stripe's receipt and renewal emails. You do not need to call or email us. If you cannot sign in, email support@thecomicchronicler.com from the email address on your account and we will cancel within one business day.
  • What happens when you cancel. Cancellation stops future charges. You keep paid access until the end of the billing period you have already paid for. We do not give partial refunds for unused time except where the law requires (see the Refund and Cancellation Policy).
  • Reminders. At least once a year you will get an email that names the Service, the amount and frequency of your charges, and how to cancel. Stripe may also email you before each renewal.
  • Price changes. If we change the price of your plan, we will email you at least 7 days, and no more than 30 days, before the new price applies to you, and you can cancel before then.
  • Promotions. If we offer a discount or promotional price, we will show its length and the regular price that applies afterwards before you subscribe.
  • Failed payments. If a renewal payment fails, it may be retried, and paid features may pause until it succeeds.
  • Taxes. Prices shown do not include sales tax. Where sales tax applies, it is added at checkout and shown on your receipt.

11. Refunds

#

Our Refund and Cancellation Policy explains when refunds are available. In short: cancel anytime, keep access through the paid period, no partial refunds except where the law requires, and goodwill refunds at our discretion. Send refund requests to support@thecomicchronicler.com; approved refunds are processed through Stripe. Any refund or chargeback ends paid access immediately.

12. Intellectual property and copyright notices

#

The Service's software, design and original text belong to us. Comic titles, characters and covers belong to their owners.

If you believe content on the Service infringes your copyright or other rights, email support@thecomicchronicler.com with the subject "Copyright notice". Please include:

  • the work you believe is infringed;
  • where the material appears on the Service, in enough detail for us to find it;
  • your name, postal address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorised by the rights owner, its agent or the law;
  • a statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights owner or authorised to act for them; and
  • your physical or electronic signature.

We review every notice and respond promptly, including by removing material where appropriate.

13. Notices and electronic communications

#

We may send notices about the Service, your account or these Terms by email to the address on your account, or show them in the Service. You agree that these electronic notices count as written notice. You can reach us at any time at support@thecomicchronicler.com.

14. Changes to the Service and to these Terms

#

We may change, add or remove features. We may update these Terms. If a change is material, we will tell you in the Service or by email before it takes effect and, where appropriate, ask you to accept the updated Terms before you continue. The "Last updated" date shows the latest version.

15. Ending your use

#

You may stop using the Service at any time, and you can ask us to delete your account (the Privacy Policy explains how). We may suspend or end your access if you break these Terms or if we stop offering the Service. If we stop offering a paid plan, we will cancel future renewals and, where the law requires, refund any prepaid amount for the unused period.

16. Disclaimers

#

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise the Service will be uninterrupted, error-free or always available.

17. Limitation of liability

#

To the fullest extent the law allows:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill; and
  • our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid for the Service in the 12 months before the claim arose, or (b) one hundred U.S. dollars.

Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or any right you have under consumer-protection law that cannot be waived.

18. Indemnity

#

If you break these Terms or the law while using the Service and that causes a claim against us, you agree to cover our reasonable costs of that claim, to the extent the law allows.

19. Governing law and disputes

#
  • These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules.
  • Talk to us first. Before filing a claim, email support@thecomicchronicler.com with a description of the problem and what you want. We will try to resolve it within 30 days.
  • If we cannot resolve it, you and we agree that any lawsuit will be brought in the state or federal courts located in Connecticut, and both of us consent to those courts' jurisdiction. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction.
  • Nothing in this section takes away a right you have under the consumer-protection laws of the state where you live.

20. General

#
  • These Terms, the Privacy Policy, the Refund and Cancellation Policy and any key-terms notice you accepted are the whole agreement between you and us about the Service.
  • If a court finds part of these Terms unenforceable, the rest stays in effect.
  • If we do not enforce a right, we have not waived it.
  • You may not transfer your rights under these Terms. We may transfer ours to a successor that agrees to honour them, such as a company we form to run the Service.
